COMPLAINT U/s 12 of The Consumer Protection Act 1986


1) The complainant is approaching this forum with relevant facts alone, necessary for adjudication of the remedies available under this statute alone (CPA 1986).

2) The Complainant sent an RTI application dated 31-12-2010, to the 2nd respondent, with a fee of Rupees 10.

3) The application contained 16 queries, which was forwarded U/s 6(3) of RTI Act to the 1st respondent.
4) Having appropriated the fee amount of rupees 10/-, the respondents declined to provide the information sought, and the 1st respondent has not supplied the information as agreed by him by his reply dated 3.3.11, even after allowing inspection of records on 14-2-11,apparently due to their misdeeds and acts of omission & commission.

5) Since their impugned action resulted in deficiency of service, the complainant caused issuance of a complaint dated 2-6-11, calling upon the Managing Director/TNHB to proceed against the 1st respondent, but to no avail.

6) As a consequence the complainant suffered mental agony and deficiency of service, valued notionally at around rupees 4 lakhs, and hence a fee of Rs.200/- is paid vide IPO dated bearing Number .

Hence the complainant prays that this Hon’ble Forum shall be pleased to,

a. Direct the respondents to compensate the complainant with rupees 4 lakhs for deficiency in service &,

b. Further direct provision of the information, and render justice.
