Sub: Application for the position of State Information Commissioner- reg.

Consequent to the enactment of RTI Act 2005, the State Information Commission was constituted. But the appointment of Chief and other Information Commissioners has created controversies for the reason that the provisions u/s 15 was not fully complied with. Especially the sub-section (5) of sec. 15 was totally neglected in the above appointments.

15(5): The State Chief Information Commissioner and the State Information Commissioners
Shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.
Non-consideration of the above section of the Act has resulted in ineffective
functioning of the Commission in all respects. For the failure of the Public Information Officers
in disseminating the information, the penalty clause u/s. 20 was not properly resorted to. This has emboldened almost all the PIOs of Public Authorities taking the short cut to deny the
crucial information. Such attitudes have totally defeated the letter and spirit of the RTI Act, besides paving way for undermining the effectiveness of the very Act.

The very basis of the Act is to ensure transparency and accountability in the functioning of the Public Authorities. But in the matter of appointment of the Commissioners, the above aspects have been given a go by, relying upon the non-formulation of any guidelines in this regard. The absence of any guidelines cannot be taken as granted for the Government to act in an arbitrary and confidential manner. The spirit behind the Act should have been borne in mind in the process of making the appointments.

Above all the present system of appointment has resulted in non-complying with various sections of the Act. The sections 4, 15, 17, 18, 19(8)(b), 20, 22, 25 and 26 are not complied with by none of the agencies of Govt., Public Authority or even by the State Information Commission. But there are rampant misuse of sec. 11 and 24 of the Act.

Hence it has become a necessity in the interest of ensuring justice and fair play to make an application by the real social activists seeking appointment as Commissioner with the sole intention and effort to secure the implementation of the Act to its letter and spirit.

Accordingly I earnestly request to consider my application.
