State chief information commissioner (SCIC) K.S. Sripathi, a former chief secretary, has come under the scanner for availing a Tamil Nadu Housing Board (TNHB) flat in Nerkundram.
Activists have appealed to the governor to take action against Mr Sripathi as SCICs cannot receive benefits/emoluments from state governments.
He took charge as SCIC on September 1, 2010, after retiring as All India Service Officer (AISO) on April 31 that year.
C. Selvaraj of ATAC, in a complaint lodged on January 17, claimed Mr Sripathi applied to TNHB for a flat in Nerkundram under a scheme “for government officials and employees” and got it.
In a separate complaint, another activist A. Shankar said SCIC was not an AISO on October 28, 2010, when the scheme was floated or on February 28, 2011, when its guidelines were framed.
“On retiring from civil service, he ceased to be a government employee and hence his claim to a flat is an effort to ‘acquire other interests’ as per section 17(3)(e) of RTI Act 2005,” Mr Selvaraj said, demanding Mr Sripathi’s removal.
SCIC, however, denied being a beneficiary of the Ne-rkundram scheme. “Every-thing has been done legally,” he told DC.

Tamil Nadu Housing Board’s Own Your Housing scheme for government officers and employees in Nerkundram had been embroiled in a controversy since its launch. A public interest litigation is pending in the Madras high court challenging the scheme.

Allotment of a flat in Nerkundram to state chief information commissioner (SCIC) K.S. Sripathi has come under scanner following complaints made by activists C. Selvaraj of ATAC and A. Shankar.

According to TNHB sources, allotment for retired IAS and IPS officers were made following verbal instruction from the higher-ups.

Besides, Mr Sripathi, retired DGPs K. P. Jain and V. Balachandran were also allotted flats in Nerkundram after their retirement from the service, RTI activist V. Gopalakrishnan said.

“The verbal instructions were given to set a cut off date on which day the then state housing minister Suba Thangavelan made the announcement about the scheme in the Assembly,” the official said.

TNHB officials said the Nerkundram scheme was meant only for the serving government officials and employees.

The guideline for Own Your Housing scheme for government officials and employees issued by the housing and urban development department on February 28, 2011, clearly states that the allotment can be availed only by government employees.

“The guideline did not mention any thing about the retired employees availing allotment under the scheme,” Mr Gopalakrishnan said

We have sought for certain information under RTI Act about the income
tax returns filed by the some of the MLAs of Tamilnadu.

The Public Authority of Assembly Secretariat has given the
information stating that the payments made to the MLAs does not come
under “salary” and it has been classified as “income from other
source”. Accordingly, as stated by the PIO, the Assembly Secretariat
is not liable to effect TDS, but the MLAs has to pay the tax directly.
The payments are directly made to the MLAs by the Assembly
Secretariat. Hence the appropriateness of the stand taken by the PIO
to be studied and decided.

The CPIO of Income tax department has simply denied the
information about the income tax return and balance sheet filed by the
MLAs of Tamilnadu.

On further investigation and analysis, it has come to light that most
of the MLAs have under reported their income, much less than the
actual income of around Rs. 6 lakhs per annum. Such details are
available in the affidavit filed by them, as is found in the web site
of Election Commission (Tamilnadu). The compiled details are enclosed
herewith (annexure -1, 2, 3 and 4).

It reveals that the MLAs are not making the due payment of income tax
commensurate to their income.

Hence it is requested to take effective steps to recover the unpaid
tax amount which is arising out of unrealistic reporting of their
income.

Sub: Application for the position of State Information Commissioner- reg.

Consequent to the enactment of RTI Act 2005, the State Information Commission was constituted. But the appointment of Chief and other Information Commissioners has created controversies for the reason that the provisions u/s 15 was not fully complied with. Especially the sub-section (5) of sec. 15 was totally neglected in the above appointments.

15(5): The State Chief Information Commissioner and the State Information Commissioners
Shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.
Non-consideration of the above section of the Act has resulted in ineffective
functioning of the Commission in all respects. For the failure of the Public Information Officers
in disseminating the information, the penalty clause u/s. 20 was not properly resorted to. This has emboldened almost all the PIOs of Public Authorities taking the short cut to deny the
crucial information. Such attitudes have totally defeated the letter and spirit of the RTI Act, besides paving way for undermining the effectiveness of the very Act.

The very basis of the Act is to ensure transparency and accountability in the functioning of the Public Authorities. But in the matter of appointment of the Commissioners, the above aspects have been given a go by, relying upon the non-formulation of any guidelines in this regard. The absence of any guidelines cannot be taken as granted for the Government to act in an arbitrary and confidential manner. The spirit behind the Act should have been borne in mind in the process of making the appointments.

Above all the present system of appointment has resulted in non-complying with various sections of the Act. The sections 4, 15, 17, 18, 19(8)(b), 20, 22, 25 and 26 are not complied with by none of the agencies of Govt., Public Authority or even by the State Information Commission. But there are rampant misuse of sec. 11 and 24 of the Act.

Hence it has become a necessity in the interest of ensuring justice and fair play to make an application by the real social activists seeking appointment as Commissioner with the sole intention and effort to secure the implementation of the Act to its letter and spirit.

Accordingly I earnestly request to consider my application.
